Welcome to Inowattio.com! These Terms and Conditions govern your use of our platform, which is owned and operated by SC INOWATTIO SRL. By accessing our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our platform.
1. Agreement to Terms
By accessing and using Inowattio.com, you confirm that you agree to these Terms and Conditions and our Privacy Policy. If you do not agree to the terms, please refrain from using the platform. You must be at least 18 years old or have parental consent to use the platform.
2. Platform Services
Inowattio offers services that enable users to manage, monitor, and trade energy in real-time. These services include energy tracking, peer-to-peer trading, energy community participation, and integration with blockchain technologies for secure transactions.
2.1. Account Creation
To use our services, you must create an account. You agree to provide accurate, up-to-date information during the registration process and keep your login credentials secure. You are responsible for all activities that occur under your account.
3. Energy Community Participation
By participating in energy communities on Inowattio, you acknowledge and agree to the following:
- Your power unit location may be shared with other community members for operational purposes, including energy coordination and trading.
- Your username is the only publicly visible information on the platform. Other personal details, such as email or phone number, are not shared without your explicit consent.
4. Service Availability and Downtime
4.1. Downtime Due to Service Providers
Inowattio relies on third-party service providers for hosting, blockchain integration, and infrastructure. In the event of downtime or outages caused by these third parties, Inowattio is not responsible for any resulting financial losses, missed energy trades, or delayed services.
4.2. Energy Balancing Event Cancellation
In case of technical issues, active energy balancing events will be canceled. Inowattio will notify the energy market about the cancellations and will not be held liable for any losses due to canceled bids or energy transactions. SC INOWATTIO SRL will handle all regulatory obligations in such instances.
4.3.Regulatory Responsibilities
In the event of system failures or downtime, SC INOWATTIO SRL will ensure all regulatory obligations are met, and necessary cancellations or adjustments are made in compliance with market regulations.
5. INO Tokens, Payments, and Wallets
5.1. INO Tokens as Sole Payment Method
All transactions on the Inowattio platform, including services and energy trading, are conducted exclusively using INO Tokens. These tokens are utility tokens within the platform and can be purchased at a stable price directly from the Inowattio website. The price of INO Tokens within the platform remains fixed and stable, unaffected by external market fluctuations. INO Tokens are utility tokens and not considered an investment or security. Inowattio does not provide any security-like responsibilities for these tokens.
5.2. VAT and Surcharges on INO Token Purchases
The price of INO Tokens includes VAT taxes and any surcharges that may be imposed by third-party payment providers. The final price paid by users for tokens may reflect these additional charges, depending on the payment method used.
5.3. Managed Wallets and ERC-4337 Compliance
Inowattio offers managed wallets for users, utilizing ERC-4337 Ethereum smart contracts for secure and programmable transactions. By using the platform, you agree that Inowattio manages these wallets on your behalf, ensuring secure internal transfers and interactions.
5.4. Token Rewards and Fiat Conversion
Users are rewarded with INO Tokens for participating in energy trading, completing tasks, and contributing to energy balancing events. When Inowattio receives rewards from energy markets, users can convert their INO Tokens to fiat currency, subject to platform availability. Fiat conversions are processed at a stable rate, in line with the platform’s token pricing model.
5.5. Public and Private Blockchain Integration
Inowattio operates a private blockchain for internal transactions, allowing users to track and verify energy flows and assignments through the Blockscout Explorer. The INO Token also has a public version on the Ethereum blockchain for external trading and transfer. While INO Tokens can be traded externally, Inowattio is not responsible for any price fluctuations or market conditions outside of the platform. The INO Token remains stable within the platform for internal transactions but may experience price volatility on external exchanges. Users trade externally at their own risk.
6. Payments and Fees
6.1. Payment Processing
All payments on the platform are conducted using INO Tokens via managed wallets. Transactions within the platform are secure and facilitated through Ethereum-based smart contracts. Inowattio is not responsible for any issues arising from external payment providers or wallet services.
6.2. Refund Policy
Transactions made with INO Tokens are final and non-refundable, except where expressly stated. Users must comply with the platform’s refund policy for eligible services.
7. Data Privacy and Security
7.1. Data Handling
Your personal data and energy usage data are processed in accordance with our Privacy Policy. All energy data collected from your system is anonymized and securely stored, ensuring privacy protection.
7.2. Data Security
We employ encryption technologies and secure access controls to protect your data. However, while we strive to provide a secure platform, no online service can guarantee absolute security, and you use the platform at your own risk.
8. Termination of Service
Inowattio reserves the right to suspend or terminate your account if you violate these Terms and Conditions or engage in unlawful activity. We may also terminate accounts to comply with regulatory requirements or at our discretion.
8.1.Account Deletion
You may delete your account at any time. Upon deletion, your personal data will be removed, but anonymized transaction data will be retained for regulatory compliance and system integrity.
9. Limitation of Liability
SC INOWATTIO SRL is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the platform, including but not limited to:
- Losses from unauthorized access to your account.
- Errors or delays in energy trades.
- Interruptions due to third-party service provider issues.
We are not responsible for losses resulting from energy balancing cancellations, platform downtime, or service outages.
10. Indemnification
You agree to indemnify and hold SC INOWATTIO SRL, its officers, employees, and partners harmless from any claims, liabilities, damages, or expenses arising out of your use of the platform or your breach of these Terms and Conditions.
11. Intellectual Property
All content on Inowattio.com, including text, graphics, software, and logos, is the intellectual property of SC INOWATTIO SRL or its licensors. You may not copy, reproduce, distribute, or create derivative works from any content without express permission.
12. Governing Law
These Terms and Conditions are governed by the laws of Romania. Any disputes will be resolved under the jurisdiction of the courts located in Sibiu, Romania.
13. Changes to Terms and Conditions
We reserve the right to modify these Terms and Conditions at any time. Any updates will be posted on this page with an updated effective date. Continued use of the platform after changes are posted indicates your acceptance of the revised terms.
